DRC Submits Comments Opposing Proposed Changes by CMS to the Pre-admission Screening and Resident Review (PASRR) Program for Nursing Facility Residents

Disability Rights California and Justice in Aging jointly submitted comments opposing proposed changes by the federal Centers for Medicaid Medicare Services to the Pre-admission Screening and Resident Review (PASRR) program. DRC’s comments align with many other disability rights organizations, nationwide, and call for a complete withdrawal of the proposed rule or that the proposal be significantly rewritten.

Disability Rights California and Justice in Aging jointly submitted comments opposing proposed changes by the federal Centers for Medicaid Medicare Services to the Pre-admission Screening and Resident Review (PASRR) program. DRC’s comments align with many other disability rights organizations, nationwide, and call for a complete withdrawal of the proposed rule or that the proposal be significantly rewritten.

In California, as in many other states, residents and staff of skilled nursing and senior residential facilities account for nearly half of the state’s COVID-19 deaths. Thus, the fundamental purpose of the PASRR program, and its implementing regulations – to prevent unnecessary admission of persons with MI or IDD to nursing facilities and to ensure that those who are admitted receive appropriate services – could never be more urgent. The administration’s proposed changes to the current federal regulations gut many of its key protections.
