RE: Undocumented Parents Applying for SSI for their Children / Padres Indocumentados que Solicitan SSI para sus Hijos

Protection and Advocacy, Inc. (PAI) has been made aware that undocumented parents of children applying for SSI are experiencing problems at the Social Security office. These problems include being told that undocumented parents will be reported to immigration if they apply, that their children are not eligible if their parents are undocumented, and that they cannot be the representative payee if they do not have a social security number. NONE OF THIS IS TRUE!

We have received clarification that Social Security workers will not have authority to report undocumented people until regulations are issued. In the meantime, people should be encouraged to apply now, since they need the income now, and the regulations may not be issued for a long time, if ever. Children who are citizens are clearly eligible for SSI if they meet the disability eligibility requirements. The attached letter from Social Security (not attached - call PAI at 1-800-776-5746 for a copy) explains how workers should process payee applications when the parent does not have a social security number. Warning to parents: DO NOT GIVE A FALSE SOCIAL SECURITY NUMBER! (READ THIS MESSAGE IF: ...)

Protección y Abogacía (PAI) se ha dado cuenta de que los padres indocumentados que solicitan SSI para sus hijos han tenido problemas en la oficina del Seguro Social. Estos problemas incluyen que les dicen a los padres que no tienen papeles que los van a reportar a la inmigración si solicitan, que sus hijos no son elegibles si los padres no tienen papeles, y que no pueden recibir cheques por sus hijos (i.e. ser "rep payee") si no tienen un número de seguro social. TODO ESTO ES FALSO!

Hemos recibido clarificación que los trabajadores de Seguro Social no tendrán la autoridad de reportar a las personas indocumentadas hasta que se implementen reglamentos. Mientras tanto, estamos recomendando que las personas soliciten ahora porque necesitan el ingreso ahora, y los reglamentos pueden tardar mucho tiempo en efectuarse. Los niños ciudadanos son claramente elegibles para SSI si reunen los requisitos de elegibilidad a causa de deshabilidad. La carta adjunta de Seguro Social (no está adjunta - llama a PAI 1-800-776-5746 si necesita una copia) explica cómo los trabajadores deben de procesar las solicitudes para ser "rep payee" cuando el padre no tiene un número de seguro social. READ THIS MESSAGE IF:

• You have a child with a disability, and

• You are not a citizen or do not have a green card, and

• Your child is a citizen (was born here), and

• You want your child to receive SSI

SOME THINGS YOU SHOULD KNOW WHEN YOU GO TO THE SOCIAL SECURITY OFFICE:

• YOUR CHILD CAN'T BE TURNED AWAY because you are undocumented!

• YOU CAN'T BE REPORTED if you don't have papers. (In the future, they may be able to report you to immigration, but the rules are not yet in effect and they do not have permission to do so).

• YOU DO NOT NEED A SOCIAL SECURITY NUMBER TO BE A "REP PAYEE." (The attached letter [not attached - call PAI at 1-800-776-5746 if you need a copy] explains how Social Security must process your application without a social security number. Give it to the worker if you have a problem.)

• DO NOT GIVE A FALSE NUMBER. Social Security creates the numbers so they will find out if you give them a false one.

If you go to the Social Security office and they tell you that your child may not apply or that they will report you to immigration, ask for the name of the worker and call PAI at:

• LOS PADRES NO NECESITAN TENER UN NUMERO DE SEGURO SOCIAL PARA RECIBIR CHEQUES POR SU NIÑO. (La carta adjunta [no está adjunta - llame a PAI al 1-800-776-5746 si necesita una copia] explica cómo el Seguro Social debe de procesar su solicitud sin su número de seguro social. Preséntela al trabajador si le da problemas.)

• NO LES DE UN NUMERO FALSO. Se darán cuenta porque ellos crean los números.

Si úd. va a la oficina del Seguro Social y le dicen que no puede presentar una solicitud o que lo van a reportar a la inmigración, pida el nombre del trabajador y llame a PAI al:
