In-Home Supportive Services (IHSS) Update

SACRAMENTO, CALIF (CDCAN) [Updated 03/11/2010  11:40 AM  (Pacific Time)] -   Several budget and legislative hearings, agency or department meetings are scheduled next week and in the weeks that follow that directly impact In-Home Supportive Services (IHSS), the program that serves over 460,000 children and adults with disabilities, the blind, mental health needs and seniors.

While the state budget process ramps up again, hearings on bills – several dealing with In-Home Supportive Services – have been scheduled, as the legislative bill process also moves forward, with critical deadlines approaching in late April and May. 

In addition there are issues related to implementation of various new requirements either for people receiving IHSS or people who are workers (providers), that was passed last July as part of the 2009-2010 revised State Budget. 

Some of the new requirements have been stopped by the courts – but others, such as unannounced home visits to some of the people receiving IHSS, and new procedures regarding signing up or enrolling new and existing IHSS workers or providers – are in effect or moving forward .

Department of Social Services Releases Proposed Draft “All County Letter”  Questions & Answers On IHSS Provider Enrollment Questions

The Department of Social Services, the state agency under the California Health and Human Services Agency, that oversees statewide the IHSS program, released yesterday (March 10) a draft “Questions and Answers” All County Letter, which addresses provider enrollment questions other than those dealing with background checks with the California Department of Justice.  A pdf copy of the 12 page draft All County Letter is attached to this CDCAN Report (titled “20100310-DSS-DRAFT-QA ACL 2 revised 3-9-10.pdf) and can also be downloaded from the CDCAN website at www.cdcan.us.   This draft should be able to be read by assistive devices used by the blind or those with sight impairments.

Other questions and answers related to the Medi-Cal Suspended and Ineligible list will addressed in a separate All County Letter, according to the Department of Social Services.

“All County Letters” (ACL) and “All County Information Notices” (ACIN) are official notices from the State to the counties  – issued by the Department of Social Services, and also by the Department of Health Care Services, that provide guidance, information or answers questions regarding implementation of new state laws that counties are responsible for implementing. 

While these notices are meant for local government agencies – such as county welfare departments – that administer locally State programs including Medi-Cal, In-Home Supportive Services – the information is available to the public and can be useful in understanding how certain new laws are being implemented.

CDCAN SUMMARY OF IHSS RELATED BILLS

Note: these are bills dealing or impacting specifically the IHSS program.  There are many other bills – including those dealing with Medi-Cal and long term care issues, mental health, aging,  regional centers and other issues that also have impact.  See separate CDCAN Report for update on those bills.

AB 1666 – LOCAL GOVERNMENT : WHISTLEBLOWER HOTLINE

  • AUTHOR: Assemblymember Sandre Swanson (Democrat – Oakland, 16th Assembly District – Capitol Office phone: 916-319-2016)
  • CDCAN SUMMARY:
    • Would specify that a city, county, or city and county auditor or controller may maintain the whistleblower hotline already authorized by existing state law, to receive calls from persons who have information regarding fraud, waste, or abuse, and would define those terms.
    • Would also authorize the auditor or controller to provide a copy of a substantiated audit report or investigation to the appropriate appointing authority for disciplinary purposes.
  • LATEST STATUS 03/04/2010:  Withdrawn from Assembly Labor and Employment Committee. Referred to Assembly Rules Committee.
  • NEXT STEPS: Must be referred and heard in an Assembly policy committee on or before April 23rd or by May 7th (depending on whether the bill needs to also go to the Assembly Appropriations Committee because of potential costs to the State)
  • CDCAN COMMENT:  This bill is not specific to In-Home Supportive Services – but would impact that and any other program administered by local government agencies. 

AB 1763 – IN-HOME SUPPORTIVE SERVICES

  • AUTHOR: Assemblymember Ted Lieu (Democrat – Torrance, 53rd Assembly District – Capitol Office Phone: 916-319-2053)
  • CDCAN SUMMARY:
    • Would require the Department of Social Services, in consultation and coordination with county welfare departments, to establish guidelines to provide counties with instructions to consistently and accurately comply with the requirements of the IHSS program.
    • Would require a county to issue a certificate to a prospective or existing provider certifying that the individual has been deemed eligible for payment after clearing a criminal background check.
    • Would require other counties to accept the certificate in lieu of a separate criminal background check.
    • Would declare that it is to take effect immediately as an urgency statute.
  • Vote: 2/3. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes.
  • LATEST STATUS 02/18/2010:  Referred to Assembly Human Services Committee.

  • NEXT STEPS: This bill currently is“urgency” or emergency measure – meaning it requires 2/3rds vote in both houses for passage – and if signed by the Governor, would take effect immediately.  The normal committee deadlines do not apply to “urgency bills”
  • CDCAN COMMENT:  Criminal background checks  for all IHSS workers (providers) were new requirements passed as part of the 2009-2010 revised State Budget in July.

AB 1801 – IN-HOME SUPPORTIVE SERVICES: QUALITY ASSURANCE

  • AUTHOR: Assemblymember Mariko Yamada (Democrat – Davis, 8th Assembly District – Capitol Office Phone: 916-319-2008)
  • CDCAN SUMMARY: 
    • Would require the Department of Social Services, already required by existing State law on or before December 31, 2010 to provide a report that evaluates the implementation of IHSS quality assurance and fraud prevention and detection efforts enacted from 2004 to present,  to continue to be required to provide this report on an on-going annual basis.
    • Would also require the Department of Social Services, in consultation with various stakeholder groups  to identify stable ongoing funding sources for IHSS services, solicit recommendations for improving the delivery of long-term care services, and solicit recommendations regarding the role the IHSS program would have in accomplishing those improvements.
    • Would require the department to report these findings and recommendations gathered as a result of these efforts to the Legislature on or before May 1, 2011.

    • Would change existing State law, by deleting the $500 limitation on a county's authority to investigate suspected fraud in connection with the provision or receipt of supportive services to overpayments of $500 or less.

AB 2274 – IN-HOME SUPPORTIVE SERVICES

    • Existing State law allows a In-Home Supportive Services recipient who receives services through either a contract or a managed care provider, subject to program requirements, to select any qualified person, as defined, to provide care.
    • Would also allow a person who receives services as part of an entity authorized by a specified federal waiver under the federal Social Security Act to select any qualified person to provide care.

AB 2374 – IN-HOME SUPPORTIVE SERVICES: PILOT PROJECT

  • AUTHOR: Assemblymember Brian Nestande (Republican – Palm Desert, 64th Assembly District – Capitol Office Phone: 916-319-2064)
  • CDCAN SUMMARY: 
    • Existing State law, commencing January 1, 2009, authorizes the establishment of a pilot project in 5 consenting counties under which the project provides persons with significant disabilities or impairments receiving services under In-Home Supportive Services, with the choice to receive IHSS either through a public authority or a contracting voluntary nonprofit or proprietary agency.
    • Would, instead, delay implementation of the pilot project to January 1, 2011, and would expand participation in the pilot project to all IHSS recipients rather than limiting participation to only those that are severely impairments.

SB 886 – IN-HOME SUPPORTIVE SERVICES PROVIDERS: E-TIMEKEEPING

  • CDCAN SUMMARY: 
    • Under existing State law , the Department of Social Services is required, in consultation and coordination with county welfare departments, to establish and implement statewide hourly task guidelines and instructions to provide counties with a standard tool for consistently and accurately assessing service needs and authorizing service hours to meet those needs.
    • Would authorize the providers (workers) of specified in-home services to use electronic timekeeping, as defined, for purposes of verifying tasks completed and ensuring quality home care for in-home recipients, as defined.
    • Would provide that, if any part of this bill conflicts with federal requirements prescribing conditions for the allocation of federal funds to the state, the conflicting part shall not be implemented, solely to the extent of the conflict.

SB 1166 – PERSONAL INFORMATION: PRIVACY

    • Would require additional requirements under existing State law that already requires any agency, and any person or business conducting business in California, that owns or licenses computerized data that includes personal information, as defined, to disclose in specified ways, any breach of the security of the system or data, as defined, following discovery or notification of the security breach, to any California resident whose unencrypted personal information was, or is reasonably believed to have been, acquired by an unauthorized person.
    • Would also require any agency, person, or business that is required to issue a security breach notification to more than 500 California residents pursuant to existing law to electronically submit a single sample copy of that security breach notification to the Attorney General, as specified.

  • CDCAN COMMENT:  While not specifically focused on the IHSS program, the law about security breaches of personal and private information covers people and workers in that program – and also a wide range of other programs serving people with disabilities, mental health needs, seniors and low income families.

OTHER BILLS TO WATCH THAT RELATE TO IHSS ISSUES

The effort to change the Medi-Cal “fee for service” program for persons with disabilities, mental health needs, the blind and seniors in the process to renew and expand the existing Medicaid Section 1115 Waiver, could have enormous impact on several programs, including IHSS.  In addition, related bills dealing with long term care issues, including SB 998 by State Sen. Carol Liu, also could have major impact.

Other bills that don’t deal with IHSS, do cover some similar issues that have raised controversy in that program.  Some of those bills are:

AB 1866 by Assemblymember Audra Strickland

(Republican – Camarillo, 37th Assembly District) dealing with required home visits (though not unannounced) of all applicants for the CalWORKS program (the state’s “welfare to work” program that also includes many children and parents with special needs and disabilities).  That bill is set for hearing in the Assembly Human Services Committee on March 23rd at 1:30 PM. 

AB 1979 by Assemblymember Anthony Adams

(Republican – Hesperia, 59th Assembly District) that is about changing existing State law so that unannounced visits to inspect all licensed child day care centers be required on an annual basis.

AB 2727 by Assemblymember Steven Bradford

(Democrat – Englewood, 51st Assembly District) dealing with employee applicant criminal history (it would prohibit  an employer from denying an application for employment for the reason that the applicant has previously been convicted of a criminal offense unless the employer determines that there is a direct relationship between the prior conviction and the employment sought or the granting of employment would involve an unreasonable risk to property or persons). This bill does not deal with IHSS workers – but the issue of criminal history has been a controversial new requirement for IHSS workers.

  • CDCAN COMMENT:  This is not an actual budget hearing on the Governor’s 2010-2011 State Budget proposals – but rather an informational hearing on the impact on Californians of major health and human services cuts previously approved (enacted) and proposals that are pending.  The subcommittee will hear from representatives of the state agencies responsible for the specific program cuts proposed and enacted, and also from the Legislative Analyst Office. 
  • Budget hearings on the specifics of the Governor’s proposals are scheduled later in April and May by the Assembly Budget Subcommittee #1 on Health and Human Services.
